The Aperio Lux Privacy Policy was updated on October 8, 2018

Your privacy is important to Aperio Lux. So we have developed a Privacy Policy that covers how we collect, use, and disclose your information. Updates of our Privacy Policy are completed frequently, thus you should review and familiarize yourself with it each time it is updated.

Collection and Use of Personal Information

Personal information is data that can be used to identity or contact a single person. 

You may be asked to provide personal information anytime you are in contact with Aperio Lux. Aperio Lux may use this personal information consistent with this Privacy Policy. We may also combine it with other information to provide and improve our products, services, content, and advertising. You are not required to provide the personal information that we have requested, but, if you choose not to do so, in some cases we will not be able to provide you with our products or services or respond to any queries you may have.

Please note: The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information. We do not collect any personal information from our applications.

What personal information we collect

  • When you send a feedback, contact us, connect to our services or participate in an online survey, we may collect a variety of information, including your name and email address, application identifier, contact preferences and IP address.

How we use your personal information

We may process your personal information for the purposes described in this Privacy Policy with your consent, for compliance with a legal obligation to which Aperio Lux is subject or when we have assessed it is necessary for the purposes of the legitimate interests pursued by Aperio Lux or a third party to whom it may be necessary to disclose information. 

  • We use your personal information to communicate with you, assistance, and improvement of experience in the use of Aperio Lux products and services.
  • We also use personal information to help us create, develop, operate, and improve our products and services, and for loss prevention and anti-fraud purposes. We limit our uses of data for anti-fraud purposes to those which are strictly necessary and within our assessed legitimate interests to protect our customers and our services.
  • From time to time, we may use your personal information to send important notices, such as communications about changes to our terms, conditions, and policies. Because this information is important to your interaction with Aperio Lux, you may not opt out of receiving these communications.
  • We may also use personal information for internal purposes such as auditing, data analysis, and research to improve our products, services, and customer communications.
  • If you enter into a sweepstake, contest, or similar promotion we may use the information you provide to administer those programs.

Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, and transfer non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

  • We may collect information regarding customer activities on our website and from our products and services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and services are of most interest. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy. This information will not be associated with your IP address.
  • With your explicit consent, we may collect data about how you use our products in order to help us improve them.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Cookies and Other Technologies

Aperio Lux’s websites may use "cookies" and other technologies such as pixel tags, web beacons and web storage. These technologies help us better understand user behavior, tell us which parts of our websites people have visited, and facilitate and measure the effectiveness of advertisements and web searches. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy.

Aperio Lux also use cookies and other technologies to remember personal information when you use our website and online services. Our goal in these cases is to make your experience with Aperio Lux more convenient and personal.

As is true of most internet services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, operating system, date/time stamp, and clickstream data. We may use this information (excluding IP address) to understand and analyze trends, to administer the site, to learn about user behavior on the site, to improve our product and services, and in our marketing and advertising services.

The IP address is stored in log files for loss prevention and anti-fraud purposes only. It will never disclose without your permission or legal basis. The IP address will be stored 4 days only. If we do not register suspicious actions (for example, DDOS attacks, fraud, etc.) from your IP address during this period, or we have no other legal reasons for further storage of your IP address, it will be erased from all log files (including back-up) after a 4-day period.

In some of our email messages, we may use a “click-through URL” linked to content on the Aperio Lux website. When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages.

Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

Web storage allows us to save some information, for example how the customers use Aperio Lux’s sites, locally on the customers’ devices. This information will be used to improve the user experience of using Aperio Lux’s sites.

Disclosure to Third Parties

It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for Aperio Lux to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

The existence of Automated Decision-Making, Including Profiling

Aperio Lux does not take any decisions involving the use of algorithms or profiling that significantly affects you.

Protection of Personal Information

Aperio Lux takes the security of your personal information very seriously. To do so, we employ a variety of security technologies and measures designed to protect information from unauthorized access, use, or disclosure. When your personal data is stored by Aperio Lux, we use servers housed in high-protected (including physical security measures) data center. All personal information is stored in encrypted form. However, please bear in mind that the Internet cannot be guaranteed to be 100% secure.

Legal Basis for Processing Personal Information

Our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.

However, we will normally collect personal information from you in the following cases:

  • we need the personal information to perform a contract with you 
  • the processing is in our legitimate interests and not overridden by your rights
  • we have your consent to do so

We have a legitimate interest in creating, administer, operating, and improving our products and services, and communicating with you as necessary to provide these products and services, for example when responding to your queries, undertaking marketing, or for the purposes of detecting or preventing illegal activities.

In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.

Access to Personal Information

In addition, you can object to the processing of your personal information, ask us to restrict the processing of your personal information, or request portability of your personal information. Again, you can exercise these rights by emailing privacy@aperio-lux.com

You can withdraw your consent to storing and using your personal information at any time.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

To protect your privacy and security, we may also take reasonable steps to verify your identity before get access, updating or removing your information. The information you provide us may be archived or stored periodically by us according to backup processes conducted in the ordinary course of business for disaster recovery purposes.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws but your ability to access, correct and delete your information may be temporarily limited where access, correction and deletion could:

  • inhibit Aperio Lux's ability to comply with a legal obligation
  • inhibit Aperio Lux's ability to investigate, make or defend legal claims
  • result in disclosure of personal information about a third party
  • result in breach of a contract or disclosure of trade secrets or other proprietary business information belonging to Aperio Lux or a third party

Children’s Privacy

Children under the age of 13, or equivalent minimum age in the relevant jurisdiction, are not permitted to provide us their personal information. If we learn that we have collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, outside the above circumstances we will take steps to delete the information as soon as possible. International Data Transfer

Aperio Lux is a global business. We may transfer personal information to countries other than the country in which the data was originally collected. These countries may not have the same data protection laws as the country in which you initially provided the information.
